Terms of Service

By using the Service during this phase, you acknowledge that:

• You are participating as a tester, not as a commercial customer
• The Service may be unstable, contain errors, or behave unexpectedly
• We may reset, modify, or discontinue the Service at any time without liability
• Your feedback during testing may be used to improve the product

FIALFA is not a registered investment adviser and does not provide registered financial advice. The Service is not designed to make investment recommendations. Any analyses provided are informational in nature and are expressly not investment recommendations.

You are solely and entirely responsible for any investment decisions you make. FIALFA will not be responsible for any losses or gains resulting from investment decisions made based on analyses produced by the Service.

• You must be at least 18 years old to use the Service.
• Access during the testing phase is by invitation only. We may revoke access at any time, with or without cause.
• By using the Service, you represent that you have the legal capacity to enter into these Terms and are not prohibited from doing so under applicable law.

If you create an account, you are responsible for:

• Keeping your credentials confidential
• All activity that occurs under your account
• Notifying us promptly at support@fialfa.ai if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable law
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Introduce malware, interfere with, or disrupt the Service or its infrastructure
• Misrepresent your identity or affiliation
• Use the Service to generate content that is harmful, fraudulent, or deceptive
• Scrape or systematically extract data from the Service

Analysis inputs: Content you submit for analysis (prompts, queries, financial data) is processed in real time and is not stored or retained after your session. You retain all rights to content you submit.

Feedback: If you provide feedback, suggestions, or bug reports during the testing phase, you grant FIALFA a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service. We will not identify you publicly in connection with your feedback without your permission.

The Service, including its interface, design, underlying technology, and all FIALFA branding, is owned by FIALFA and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

The Service may integrate with or reference third-party services. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is governed by their own terms and policies.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Given the pre-commercial testing phase, we make no representations that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIALFA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising under these Terms will not exceed the amount you paid us in the 12 months preceding the claim, or CAD $100, whichever is greater.

You agree to indemnify and hold harmless FIALFA and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Service will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to the courts of Ontario, Canada.

We may update these Terms at any time. We will provide reasonable notice of material changes by email or by posting a notice on the Service. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance.

We may suspend or terminate your access to the Service at any time, for any reason, without notice or liability. You may stop using the Service at any time. Provisions that by their nature should survive termination — including disclaimers, limitation of liability, and governing law — will survive.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FIALFA regarding the Service and supersede any prior agreements.
